The agreement under which we provide digital marketing services. Plain English, no surprises. Compliant with Australian Consumer Law.

These Terms of Service ("Terms") govern your use of the website at https://austradigital.com.au and any services provided by AUSLOVE TV PTY LTD (ABN 67 613 196 802), trading as Austra Digital Marketing Agency ("we", "us", "our", "Austra Digital"). By using our website or engaging us, you agree to these Terms.
1. Website use
You may use this website for personal and lawful purposes only. You must not:
- Use the site in a way that breaches any Australian law or regulation
- Attempt to gain unauthorised access to our systems or any third-party systems linked from the site
- Reverse engineer, scrape or republish material from the site without our written consent
2. Intellectual property
All content on this website — text, images, layout, code, brand marks — is owned by us or our licensors and protected by Australian and international copyright law. You may not reproduce, modify, or distribute it without our written permission.
For client work delivered to you under a separate services agreement, intellectual-property ownership transfers as set out in that agreement.
3. Services
Where we provide services to you, those services are governed by a separate written engagement (a statement of work, services agreement, or written quote) that we will issue and you will accept before work begins. That agreement, together with these Terms, forms the complete arrangement between us.
4. Fees and payment
Fees are set out in the relevant services agreement. Unless otherwise stated:
- Invoices are payable within 14 days of issue
- Recurring retainers are invoiced monthly in advance
- Paid-media management fees are calculated on actual spend
- All fees are in Australian dollars and exclusive of GST unless stated otherwise. GST applies at 10% where applicable
- Late payments may incur a reasonable administration charge and may result in services being paused
5. Engagement and termination
Our standard engagement is month-to-month after an initial onboarding period (typically 90 days). Either party may end an ongoing engagement on 30 days written notice. Project-based engagements end when the scope is delivered.
We may suspend or end an engagement immediately if you materially breach the agreement (including non-payment), or if you ask us to do work that we reasonably believe is unethical or unlawful.
6. Client responsibilities
For us to do good work, you agree to:
- Provide timely access to advertising accounts, analytics, CMS, and other systems we need
- Approve creative, copy and campaign launches in a reasonable timeframe
- Provide accurate information about your business, products and services
- Pay invoices on time
7. Australian Consumer Law
Our services come with guarantees under the Australian Consumer Law (ACL) that cannot be excluded. Nothing in these Terms attempts to exclude, restrict or modify those rights.
To the extent permitted by law, our total liability for any breach of these Terms or in connection with services we provide is limited, at our option, to either resupplying the services or refunding the fees paid for the services that caused the loss.
8. No guaranteed outcomes
Digital marketing depends on many factors outside our control — search-engine algorithms, ad-platform policies, market conditions, your product and pricing, and how quickly you respond to leads. We commit to applying skill, care and our best professional judgment. We do not guarantee specific rankings, traffic, leads, sales or return on ad spend.
9. Third-party platforms
Our services rely on third-party platforms (Google, Meta, TikTok, Shopify, Klaviyo, etc.). We are not responsible for changes to their policies, pricing, APIs, account suspensions, or service outages. We will work in good faith to mitigate any impact.
10. Confidentiality
Each party will keep the other's confidential information confidential and use it only for the purposes of the engagement. Confidentiality survives the end of the engagement.
11. Privacy
How we handle personal information is set out in our Privacy Policy.
12. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be at https://austradigital.com.au/terms. Where changes materially affect an existing engagement, we will tell you in writing before they take effect.
